{"id":4400,"date":"2024-03-13T17:17:27","date_gmt":"2024-03-13T12:17:27","guid":{"rendered":"http:\/\/sub.kasaba.uz\/toshvil\/?p=4400"},"modified":"2025-01-24T10:53:40","modified_gmt":"2025-01-24T05:53:40","slug":"xodimlar-manfaatini-himoya-qilish-oson-kechmaydi","status":"publish","type":"post","link":"http:\/\/toshvil.kasaba.uz\/?p=4400","title":{"rendered":"XODIMLAR MANFAATINI HIMOYA QILISH OSON KECHMAYDI"},"content":{"rendered":"\n<p>\u201cISHONCH\u201d muxbiri XOLIDA EGAMBERDIEVA suhbatlashdi.<\/p>\n<p>\u00a0 <strong>Ayni<\/strong><strong> paytda<\/strong><strong> O\u2018zbekiston<\/strong><strong> Sog\u2018liqni<\/strong><strong> saqlash<\/strong><strong> xodimlari<\/strong><strong> kasaba<\/strong><strong> uyushmasi<\/strong><strong> Toshkent<\/strong><strong> viloyati<\/strong><strong> kengashi<\/strong><strong> tarkibida<\/strong><strong> 86 ta<\/strong><strong> tashkilot<\/strong><strong>, 65 ming<\/strong><strong> nafardan<\/strong><strong> ziyod<\/strong><strong> kasaba<\/strong><strong> uyushma<\/strong><strong> a\u2019zolari<\/strong><strong> ro\u2018yxatga<\/strong><strong> olingan<\/strong><strong>. <\/strong><\/p>\n<p><strong>Ushbu<\/strong><strong> tarmoqning<\/strong><strong> Toshkent<\/strong><strong> viloyati<\/strong><strong> bo\u2018yicha<\/strong><strong> mehnat<\/strong><strong> huquq<\/strong><strong> inspektori<\/strong><strong> tomonidan<\/strong><strong> 2023 yil<\/strong><strong> davomida<\/strong><strong> sudlarga<\/strong><strong> 25 ta<\/strong><strong> da\u2019vo<\/strong><strong> arizalari<\/strong><strong> kiritilgan<\/strong><strong> bo\u2018lib<\/strong><strong>, tizimdagi<\/strong><strong> 700 nafarga<\/strong><strong> yaqin<\/strong><strong> ishchi<\/strong><strong>-xodimlar<\/strong><strong> manfaati<\/strong><strong> tiklangan<\/strong><strong>. Undirib<\/strong><strong> berilgan<\/strong><strong> mablag\u2018lar<\/strong><strong> esa<\/strong><strong>, 2 mlrd<\/strong><strong>. 240 mln<\/strong><strong> 369 ming<\/strong><strong> so\u2018mni<\/strong><strong> tashkil<\/strong><strong> qilgan<\/strong><strong>. <\/strong><\/p>\n<p><strong>\u00a0<\/strong> \u201cIshonch\u201d muxbiri xodimlar manfaatini tiklash jarayonining borishi xususida batafsil ma\u2019lumotlar olish maqsadida, sog\u2018liqni saqlash tarmog\u2018ining mehnat huquq hamda mehnat texnik inspektorlari bilan suhbatlashdi.<\/p>\n<p>\u00a0 <strong>Muhammadjon<\/strong><strong> Ro\u2018zmetov<\/strong><strong>, O\u2018zbekiston<\/strong><strong> Sog\u2018liqni<\/strong><strong> saqlash<\/strong><strong> xodimlari<\/strong><strong> kasaba<\/strong><strong> uyushmasining<\/strong><strong> Toshkent<\/strong><strong> viloyati<\/strong><strong> bo\u2018yicha<\/strong><strong> mehnat<\/strong><strong> huquq<\/strong><strong> inspektori<\/strong><strong>:<\/strong><\/p>\n<p>\u2014 Tashkilotlardagi aksariyat ish beruvchilar, xodimlar bo\u2018limi boshliqlari hamda hisobchilar mehnat qonunchiligida belgilangan normalardan to\u2018liq xabardor emas. Ularning ko\u2018pchiligi mehnat qonunchiligi bo\u2018yicha yetarli bilimga ega emasligi tizimda qonunbuzilish holatlarga yo\u2018l qo\u2018yayotganligida namoyon bo\u2018lmoqda.<\/p>\n<p>Qonunchilikka muvofiq, tibbiyot sohasida ta\u2019til kunlari, rag\u2018batlantirish va oylik maoshga ustama to\u2018lanishining boshqa sohalardan farqli tomonlari bor. Misol uchun, zararli omillar bilan ishlaydigan xodimlar uchun jamoa shartnomasiga asosan, 6 kundan 12 kungacha qo\u2018shimcha ta\u2019til berilishi belgilab qo\u2018yilgan. Ya\u2019ni, texnik xodimlarga 6 kun, o\u2018rta ma\u2019lumotli va asosiy xodimlarga 9 kun hamda zararli omillar bilan ishlaydigan xodimlarga 12 kun qo\u2018shimcha ta\u2019til berilishi kerak. Zararli omillar bilan ishlovchi xodimlarga ish o\u2018rni attestatsiyasi bo\u2018yicha yana qo\u2018shimchalar belgilangan. Ish beruvchi ko\u2018pincha ish o\u2018rni attestatsiyasini o\u2018tkazmay turib, mehnat ta\u2019tiliga o\u2018sha kunlarni qo\u2018shmaydi.<\/p>\n<p>Yangi mehnat kodeksining 221-moddasida xodimning ishlagan har 5 yili uchun qo\u2018shimcha ikki kundan ijtimoiy ta\u2019til belgilangan. Tibbiyot xodimlari orasida 20 yildan ortiq ishlaganlari bor. Demak, ularga 8 kundan oshmagan ijtimoiy ta\u2019til qo\u2018shib berilishi kerak. Mana shu omilni inobatga olmaslik holatlari ham ko\u2018p. Shuningdek, mehnat kodeksining 401-moddasida 12 yoshgacha ikki va undan ortiq bolalarni yoki 16 yoshgacha nogironligi bo\u2018lgan farzandni tarbiyalayotgan ota-onalarning biriga 4 kun yana qo\u2018shimcha ta\u2019til belgilangan. Bu normalar xodimning yillik mehnat ta\u2019tiliga qo\u2018shilishi va belgilangan tartibda hisob-kitob qilinishi lozim.<\/p>\n<p>Xodimning manfaatini himoya qilish oson kechmaydi, albatta. Faoliyatimizda ish beruvchining noto\u2018g\u2018ri hisoblangan mablag\u2018larni to\u2018lashdan bosh tortib, \u201ckerak bo\u2018lsa, sud orqali undiring\u201d deydigan holatlar ko\u2018p bo\u2018ladi. Keyin ish sudga oshiriladi. Qonunbuzilishga yo\u2018l qo\u2018yilganligi sudda isbotlansa, avvalo ish beruvchiga davlat boji to\u2018lash yuklanadi. Shuningdek, bir nechta xodimning sudlarda ishtirok etish uchun ishdan qolishiga to\u2018g\u2018ri keladi, fuqarolik ishi\u00a0kamida 2-3 marta bo\u2018lib o\u2018tadi va bu jarayon tashkilotning obro\u2018siga ham salbiy ta\u2019sir qilmay qolmaydi.<\/p>\n<p>Noto\u2018g\u2018ri hisoblangan mablag\u2018larni undirish yoki xodimni ishga tiklash jarayonida inspektorlarni eng ko\u2018p\u00a0qiynaydigan narsa hujjat yig\u2018ish ishlaridir. Ya\u2019ni har bir xodimga tegishli bo\u2018lgan 4-5 tagacha hujjat yig\u2018ilishi kerak. Barcha hujjatlar elektron holatda Adolat.uz elektron portaliga joylanadi. Keyin ular tekshirilgach, sud bo\u2018ladigan kuni belgilanadi. Lekin ko\u2018p hollarda ish beruvchilar tomonidan xodimlarga tegishli bo\u2018lgan zarur hujjatlar o\u2018z vaqtida taqdim etilmaydi. Buning oqibatida anchagina vaqt yo\u2018qotiladi. Hujjatlar yig\u2018ilgach, birinchi instansiya sudlari, agar taraflar noroziligi bo\u2018lsa, appellyatsiya, kassatsiyagacha fuqarolik ishi\u00a0bo\u2018lib o\u2018tadi. Bu ba\u2019zan bir necha oy vaqtni talab qilishi ham mumkin.<\/p>\n<p>Shuning uchun avvalo qonunbuzilish holatiga yo\u2018l qo\u2018ymaslik, mabodo shunaqa holat aniqlansa, noto\u2018g\u2018ri hisoblangan pullar o\u2018z vaqtida to\u2018lab berilishi kerak. Aks holda ish sudga oshirilsa, ko\u2018pgina ovoragarchiliklar kelib chiqaveradi.<\/p>\n<p>Ayni paytda tizimdagi ish beruvchilar, kadrlar bo\u2018limi boshliqlarini va hisobchilarni ko\u2018proq o\u2018qitish va malaka oshirishga ehtiyoj bor.
